These Terms of Service ("Terms") govern your use of the PocSomm mobile application ("the App") operated by Melkar, LLC ("we", "us", "our"). By using the App, you agree to these Terms.

Age Requirement

PocSomm contains information about alcoholic beverages. You must be of legal drinking age in your jurisdiction (at least 18 years old) to use the App. By using PocSomm, you confirm that you meet this age requirement.

Description of Service

PocSomm is a wine scanning and sommelier assistant tool. It uses AI technology to analyze wine lists, bottle labels, and food menus to provide wine information, food pairing suggestions, and pricing insights.

Credit System and In-App Purchases

• PocSomm uses a credit system for AI-powered scanning features. New users receive an initial grant of credits.
• Additional credits may be purchased through in-app purchases via Apple's App Store.
• All credit purchases are consumable and non-refundable. Credits are consumed when you perform scans and cannot be transferred or exchanged.
• Each scan uses credits based on page count (1-2 pages = 1 credit).
• Credits are stored on your device. Deleting all app data from Settings will reset your credit balance to zero.

AI-Generated Content Disclaimer

Wine information, ratings, pricing estimates, and food pairing suggestions provided by PocSomm are generated by artificial intelligence and should be treated as informational guidance only. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Specifically:

• Wine ratings and scores are sourced from AI analysis and may not reflect the latest critic reviews.
• Retail price estimates are approximate and vary by market and retailer.
• Food pairing suggestions are AI-generated recommendations, not professional sommelier advice.
• Wine descriptions and tasting notes are generated content and may contain inaccuracies.

Always verify critical information independently.

Acceptable Use

You agree not to:

• Use the App if you are under the legal drinking age.
• Attempt to manipulate, reverse-engineer, or exploit the credit system.
• Use the App for any unlawful purpose.

Health and Safety

Please drink responsibly. Excessive alcohol consumption is harmful to your health. PocSomm provides information about alcoholic beverages but does not promote excessive consumption.

Intellectual Property

PocSomm, including its design, features, and content, is the property of Melkar, LLC. Wine information sourced from AI providers is subject to those providers' terms.

Limitation of Liability

PocSomm is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Melkar, LLC shall not be liable for any damages arising from your use of the App, including but not limited to reliance on AI-generated content.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.
